Climb to the Cup Contest
Official Contest Rules (“Contest Rules”)
1. Sponsor. The “CLIMB TO THE CUP CONTEST” (“Contest”) is sponsored by Vancouver Whitecaps FC L.P., a limited partnership with its principal place of business at Suite 201, 788 Beatty Street, Vancouver, British Columbia CANADA V6B 2M1 (“Sponsor” or “Club”).
2. Eligibility. This Contest is open to legal residents of the province of British Columbia (the “Territory”), who are at least nineteen (19) years of age at the time of entry, with the exception of employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Sponsor, Major League Soccer, L.L.C. (“MLS”) and its member teams, Soccer United Marketing, LLC (“SUM”), MLS Canada ULC (SUM, MLS Canada ULC and collectively with Sponsor and MLS, the “MLS Entities”) and each of their respective parents, governors, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Contest who are not eligible to participate or win a prize. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules. Entrants who do not comply with any of the Contest Rules are subject to disqualification by the Sponsor, in Sponsor’s sole discretion. The Contest is subject to all applicable federal, provincial, and local laws, rules and regulations. Void outside the Territory, in Quebec, and where prohibited or restricted by law, rule or regulation.
3. Contest Dates and Times. Contest begins at 10:00 AM PDT on May 16, 2025 and ends at 11:59 PM PDT on May 26, 2025 (“Entry Period”) after which time the Contest will be closed and no further entries will be accepted. The clock of the Sponsor will be the official time-keeper for this Contest.
4. How to Enter. No purchase is necessary to enter the Contest. Enter using one of the methods of entry below during the Entry Period. No other method(s) of entry will be accepted. Limit one (1) entry per person, per family, per e-mail address, social media handle or Facebook login, per household, as applicable, regardless of method of entry. Multiple entries received from any person or family or e-mail address or household in excess of the stated limitation will be void. All information and files submitted in the format specified will become property of Sponsor and used by the Club as provided in the MLS Terms of Use and Privacy Policy, each of which can be found at section 12 of these Contest Rules .
To enter, during the Entry Period, go to whitecapsfc.com/final and click on the banners, buttons and/or links to access the online entry form for the Contest and register by filling out the required fields on the Contest entry page which will include:
a. First Name
b. Surname
c. E-mail address
d. Telephone Number
e. Post Code
By submitting your completed online entry form, you will receive one (1) entry in the Contest. Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Incomplete entries are void. Online entrants to the Contest will be given the option to receive commercial e-mails from MLS Entities; however, eligibility to participate in the Contest is not dependent upon entrant’s consent to receive such e-mails and consenting to do so will not increase your chances of winning.
For an offline entry without purchase, you will receive one (1) entry in the Contest if you complete an index card (handwritten or typed) with your name, e-mail address, telephone number, and address printed on one side with a brief comment (less than 100 words) on why you love the Vancouver Whitecaps FC, send your entry by regular mail to Climb to the Cup Contest c/o 201-788 Beatty Street, Vancouver, British Columbia CANADA V6B 2M1 and your entry is received and accepted by the Sponsor prior to end date and time for the Entry Period.
Proof of submission is not considered proof of delivery to or receipt of such entry. Furthermore, Sponsor shall have no liability for any entry that is lost, intercepted or not received by the Sponsor.
Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void. Entrants grant Sponsor a non-exclusive, fully paid-up and royalty free, licence to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate all entries for any purpose in any media formats through any media channels throughout the world. No correspondence will be entered into except with Selected Entrants. Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry.
Additionally, each entry (“Entry”) must meet the following “Entry Requirements” (any Entry that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):
f. Entrant must be the rightful owner of the Entry included with the entry or must have the rights, title and interest necessary to utilize the Entry for the Contest in compliance with these Contest Rules;
g. Entrant must be the rightful owner of the e-mail address associated with the Entry;
h. Entry must NOT contain any material that infringes or violates any right of a third party including copyright, patent, trademark, trade secret or other proprietary rights, other than those relating to the MLS Entities. For example, Entry should NOT contain reference to sports team logos, celebrities, names or logos of businesses, music or lyrics, or clips from television shows or movies, other than those related to the MLS Entities;
i. Entry must NOT contain subject matter which is, or could be considered, in the sole discretion of the Contest Entities, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), defamatory, libelous, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., illegal gambling, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful, tortious or objectionable;
j. Entry must NOT contain any content that promotes any particular political agenda or message;
k. Entry must NOT contain any personal identification, such as personal names or e-mail addresses (other than that of the rightful owner of the e-mail address or other personal information associated with the Entry);
l. Entry must NOT communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate or otherwise contain content which Sponsor in its sole discretion decide is inappropriate or objectionable;
m. Entry must NOT violate any law, rules, or regulation;
n. Entry must NOT contain or reference any names, products or services of any company or entity, or promotes any brand, product or service of any company or entity, excepting those of Sponsor; and
o. Entry must NOT contain any derogatory references to any of the MLS Entities.
Sponsor reserves the right, in its sole discretion, to disqualify any entry in the Contest if Sponsor views the Entry as potentially infringing or otherwise a violation or potential violation of a third party’s rights or if it deems the Entry to be lacking in taste, quality, or to be otherwise objectionable. Sponsor reserves the right to waive the Entry Requirements in its reasonable discretion.
Entrants understand that they are posting their Entry at their sole risk. Sponsor is not responsible for any claims arising from the Entries, specifically including, but not limited to, claims for intellectual property infringement and privacy rights violations, as well as violations of the respective social media platform’s terms and conditions.
5. Contest Prizes. A total of one (1) prize pack is available to be won consisting of:
a. two (2) game tickets to the CRUZ AZUL v. Vancouver Whitecaps FC 2025 Concacaf Champions Cup Final Match scheduled to take place on June 1, 2025 at Estadio Olímpico Universitario, Mexico City, Mexico (approximate retail value: $125.00 per ticket or $250.00 Canadian dollars in total);
b. two (2) round-trip economy airline tickets (one for the winner plus one (1) guest) from Vancouver to Mexico City departing on May 31, 2025 (approximate retail value: $850.00 per ticket or $1,700.00 Canadian dollars total);
c. two (2) night’s standard hotel accommodation in or near Mexico City for two (2) people (single room, double occupancy) (approximate retail value: $400.00 Canadian dollars total);
d. two (2) Vancouver Whitecaps FC Authentic Peak Jerseys (approximate retail value: $210.00 per jersey or $420.00 Canadian dollars in total); and
The total approximate retail value of the winning prize pack is $2,770.00 Canadian dollars.
Travel Terms and Conditions
a. If selected, the prize winner and their guest must be able to travel on the date(s) stated above or as otherwise determined at the Sponsor’s sole discretion. If the prize winner and guest cannot travel on the date(s) specified by Sponsor, the prize will be forfeited in its entirety and the prize may be awarded to an alternate Selected Entrant chosen from among all remaining eligible entries in the manner described herein, if time permits;
b. Both the prize winner and their guest must have reached the age of majority in the Province of British Columbia, unless the guest is accompanied by a parent or legal guardian;
c. A valid major credit card may be required to be presented by the prize winner and/or their guest at the hotel check-in for incidental expenses, deposit or damage protection purposes;
d. If the prize winner elects to travel without a guest, no additional compensation will be awarded;
e. Tickets are subject to certain terms and conditions as specified by airline issuers and travel suppliers and shall expressly include any airline carrier’s regulations and conditions. Documentation that is reasonably necessary for Sponsor to book the prize for the winner and their guest must be supplied upon request. Failing to do so may deem a participant ineligible and result in their prize being forfeited in its entirety and the prize may be awarded to an alternate Selected Entrant chosen from among all remaining eligible entries in the manner described herein, if time permits;
f. The prize winner and their guest must obtain prior to departure and carry with them all necessary travel documentation, such as valid passports and visas for entry into Mexico and their return into Canada, complying at all times with entry, health, safety, customs and immigration regulations and requirements;
g. The prize winner and their guest are responsible for any and all costs, surcharges, fees, charges, expenses and taxes not expressly described and/or provided for herein including, without limitation, ground transportation to and from the departure point, gratuities, merchandise, telephone calls, personal expenses of any nature for meals, beverages, service charges, obtaining sufficient personal travel insurance prior to departure, if desired;
h. Sponsor reserves the right to substitute a prize for one of equal or greater value if any element of the prize contained herein becomes unavailable;
i. No responsibility is assumed for: any cancellations, alterations, delays, diversions or other changes to the trip itinerary or prize-related event; any costs or expenses incurred as a result of any changes to the trip itinerary; or any damages, loss or liability in the event any prize winner or their guest is denied the ability to travel, whether due to airport restrictions or otherwise. The prize winner agrees and acknowledges that the Sponsor will not be liable if the prize winner or their guest are denied boarding or entry due to any failure to comply with applicable travel restrictions or requirements;
j. Sponsor is only responsible for the prize elements listed in these Contest Rules, subject to the terms and conditions contained in these Contest Rules. All travel arrangements, room selection and accommodations are subject to availability and at Sponsor’s sole discretion;
k. All travel tickets issued in connection with the prize are not eligible for frequent flyer miles;
l. Sponsor has the right to disqualify or remove any prize winner or their guest from any activity at any time if they are at any point uncooperative, disruptive, abusive, or unobservant of applicable rules, laws or regulations, or likely to cause or has caused damage to person, property, or the reputation of Sponsor;
m. The prizes are provided on an ‘as is’ and ‘as available’ basis without representations, warranties or conditions of any kind, whether express or implied, including without limitation any implied warranties or conditions of title, non-infringement, functionality, accuracy merchantability, merchantable quality, durability or fitness for a particular purpose; and
n. The prize winner’s guest must complete and return a publicity and liability release concurrent with the prize winner’s completion of the Winner’s Release (defined below).
All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or the use or redemption of a prize. Prizes must be accepted as awarded and have no cash value. The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the Prize (or portion thereof) with one of comparable or greater value, at its sole and absolute discretion.
6. Odds of Winning. The odds of winning depend on the number of eligible entries received during the Entry Period.
7. Skill-testing Question. Selected Entrants (as defined below) will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, Sponsor’s time-limited, mathematical skill-testing question to be administered by telephone.
8. Winner Selection and Confirmation. On May 27, 2025 at 11 AM PDT at Suite 201, 788 Beatty Street, Vancouver, British Columbia CANADA V6B 2M1 (“Draw Date”) Sponsor, or an employee, agent or other representative of Sponsor, will conduct a random draw from all eligible entries received during the Entry Period and select the potential winner (each a “Selected Entrant” and collectively, the “Selected Entrants”). Selected Entrants will be deemed a winner if they meet all of the eligibility criteria set out in these Contest Rules. If a Selected Entrant does not meet the eligibility criteria, he/she will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw from the remaining eligible entries. Before being declared a winner, a Selected Entrant will be required to: (i) correctly answer Sponsor’s skill-testing question; and (ii) sign and return Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (“Winner Release”) to (A) confirm compliance with all Contest Rules, (B) agree acceptance of the prize as awarded, and (C) agree the release and indemnification of the Released Parties (as defined in and as set forth in section 9 below), all in the sole discretion of Sponsor.
Selected Entrants will be notified as soon as practicable after the Draw Date and will be contacted through the entry method provided at the time of entry into the Contest. Up to three attempts will be made to contact Selected Entrants following the draw. A Selected Entrant that does not or cannot accept a prize may be forfeited and a new Selected Entrant selected by random draw, in Sponsor’s sole discretion. A signed copy of Sponsor’s Winner Release must be received by the Sponsor no later than 11:59 PM PDT on May 29, 2025, or as may otherwise be stipulated by Sponsor. Sponsor is not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for the Sponsor to receive a Selected Entrant’s response.
Disputes regarding identity of entrant: If the identity of a Selected Entrant is disputed, the Entry will be deemed to have been submitted by the individual assigned to the user account entered at the time of entry (“Authorized Account Holder”). Each Selected Entrant may be required to provide proof that he/she is the Authorized Account Holder associated with a selected Entry.
9. Release and indemnification. All entrants, as a condition of participation in the Contest, agree to release, discharge and hold harmless the MLS Entities including, for the avoidance of doubt, Sponsor, and each of its and their departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (“Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of entries by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of prizes as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize, and the use of entries by Sponsor.
Sponsor is not responsible for: (i) incorrect or inaccurate entry information that may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries that fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Winner Releases; (iv) injury or damage to entrants’ computers or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, including any related travel and the use of entries by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.
10. Other Conditions. Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice to entrants. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, Sponsor reserves the right to cancel the Contest and conduct a random draw from all previously received eligible entries received during the Entry Period.
11. Publicity and Entrant Information. By participating in the Contest, entrants consent to the use of their name, address, email address, postal code, telephone number, social media handle(s), comments and image, whether on videotape, photograph or any other means, for the administration of the Contest or any publicity carried out by the Sponsor, without further notice or compensation.
12. Privacy/Use of Personal Information. Sponsor respects the entrants’ right to privacy. Personal information collected from entrants will only be used by Sponsor to administer the Contest and, if only consent is actively given at the time of entry, to deliver commercial emails or other electronic communications of a commercial nature to entrants from Sponsor or third parties (in which case disclosure of an entrant’s personal information shared with a third party will be subject to that party’s privacy policies and practices). For more information regarding the manner of collection, use and disclosure of personal information by the Sponsor/Club, please refer to MLS Terms of Use and Privacy Policy, each of which can be found by visiting http://www.mlssoccer.com/terms-service and http://www.mlssoccer.com/privacy-policy (both of which are incorporated herein by reference).
13. Law. The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of the province of British Columbia, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest rules, rights and obligations between entrants and Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Vancouver, British Columbia.
14. Rule Amendments. Sponsor reserves the right, in its sole discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.
15. Intellectual Property. All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by Sponsor or property of their respective owners. All rights reserved. Unauthorized copying or use of any intellectual property without the express written consent of Sponsor is strictly prohibited.
16. Contest Administration and Sponsor. The Contest is in no way sponsored, endorsed, or administered by or associated with the MLS Entities (other than Sponsor), Facebook, Instagram or any other social media service or platform. The Sponsor of this Contest is:
